Minutes

 

The meeting was called to order by President Maureen Carr-York at 7:35 pm at the Severna Park Library.

 

Secretary’s Report:  Wes Adams distributed the August meeting minutes to the membership via email. Without objection the minutes were approved as submitted. 

 

Treasurer’s Report: Steve Poland submitted the August Finance report which was read to the membership. Below are the key numbers from the report which will be filed for audit. All GSPC moneys are FDIC insured.

President’s Report:   Nothing new to report. 50 Communities in Good Standing/12 in Arrears

 

Special Guests:  Superindent of Schools Dr. Kevin Maxwell – (With him were - Alex Szachnowicz, Chief Operating Officer  and Cathy Herbert, Director of School Performance) – Addressed the delegation providing us with a “state of the Anne Arundel County Schools.”  He commented on the high performance of the students in this area on the MSA’s and the national recognition of the school.  He also addressed the new middle school schedule.  He highlighted the Harvest for the Hungry food drive and the community focus of the school.

 

Cathy Herbert – Discussed the Severna Park feeder system – complimenting the parents and the community for keeping their students prepared.

 

Alex Szachnowicz – Discussed the school infrastructure – $1.5B deficit in 2005 dollars for infrastructure improvements and renovation (including a $190M backlog in maintenance projects).  Somewhere in year 40-45 schools are in serious need of renovation and restoration.  That time is NOW.  The gap between where the school buildings belong and where they currently are grows larger each year. 

 

We are eligible for up to 50% matching money by the State, but we only see about a maximum of 25% matching money from the State.  

 

Next Wednesday, the Board Of Education has a public hearing on adoption of the Capital Budget.  Need to not only show up and be heard there, but need to make your voice heard with the County Executive and the County Council.

 

Folger McKinsey is 1/3rd funded – there will be reluctance to start without the remaining 2/3rds.

Feasibility and Design money for Benfield Elementary and Feasibility money for SPHS requested for the current fiscal budget.

 

Doubled the number of portable trailers to accommodate the full day kindergarten mandate.  They have preparing to fund small additions to accommodate kindergarten classes in the schools and out of the trailers.

 

The guests then entertained questions from the delegation, on school funding, line item appropriations, length of recess, bullying in the schools and other issues.

 

A question as to what was the Priority of the S.P. High School Feasibility Study on the A.A. Co. School Supt.'s List of Requests to the School Board for FY2011 Capital Improvement Programs was posed to the guests.  In discussions the Supt. & School C.O.O. referred to the  www.AACPS.Org  web site for the list of FY2011 CIP requests, which shows the SPHS as Priority No. 30 on the list of 40 requests.

 

Jim Laite – Newly Elected Booster Club President and Jim Pack – Vice-President addressed the delegation regarding athletic and academic funding for the High School.  They provide uniforms every three years, new balls, equipment, built the field house, etc.

 

First major funding event – Dinner at Bill Bateman’s Thursday, September 10.  Another is scheduled for October.  Bull and Oyster Roast at the Earleigh Heights Fire Department on October 16.

SPFALCONBOOSTER@YAHOO.COM  is Jim’s email address and WWW.FALCONBOOSTERS.COM is their website.  They are also planning a golf tournament in the spring.

 

Jim Rausch and Michele Rose – Friends of Kinder Park – addressed the delegation about their involvement with Kinder Park and the Fall Harvest Festival – the major fundraiser for the park.  Please volunteer for a 4 hour shift.  That Date is Saturday October 10.  Also consider becoming a member of the Kinder Farm Park – only $10.

Education Committee:   Middle School is in its 3rd phase of construction.  There is an on-line forum and discussion group at SPHS_CAC@yahoo.com.

 

Environmental Committee:  Greater Severna Park Watershed Action Committee – Earth Day upcoming on April 24, 2010 at St. Martin’s in the field. 

 

Police Relations: Scam artist coming around to fix cars, hard selling their services.  They have out-of-state plates.  Please beware.

           

Public Works: Nothing new to report.  Highway and road budget backlog.

 

ASPIRE:  No new Report.  Severna Park Heritage Day planned for October 24, 2009 – more information to follow.

BWI Noise Committee:  No Report. 

 

Nominating Committee:  John Norville announced that  annual elections will be held in December and asked Delegates to think about being candidates.

 

Bylaws Revision  -  Nothing new to report.

 

Aspire Report –Nothing to report.

 

Zoning/Legislation:  Presentation by Al Johnson – Discussion of Rules Changes in Board of Appeals and Brief discussion of the GDP.  Discussion of the various bills, cases, etc. concerning zoning and legislation being followed by Al Johnson.

  Case C-08-133214 (BA 76-06R, 20006-223R) Berrywood et al v Marketplace. 7-6-09, Judge Wachs reversed the

     Order of the Board of Appeals and reinstated the Order of the AHO denying an application for piecemeal

     rezoning from R5 to C2.  Judge rejected as a matter of Law the Board of Appeals finding of mistake on the

     County Council’s failure to specifically discuss the subject property and that the R5 classification of the

     conservation easement as part of a large commercial development did not amount to a taking.  Request for  

     $2,306.50 Costs Order under Rule 7-116.  Order granting costs 8-20-09.

Court of Special Appeals Cases 410 260-1450 

  Case 60, 2009 Term, In the Matter of Chesapeake Bay Foundation Inc, et al, (Little Dobbins Island), dismissed by

      Board of Appeals-Lack of Standing. Appellant’s Brief due 9-15-09.    

  Case 2250 Sept Term 2007 Steve Curtis v. AA Cnty (Circuit Court Case C-07-120132, BA82-02A) Application for   

      C2 in R2 zone, Applicant argued County Council made a mistake for not affirmatively considering during rezoning,

     (Crain West) 

     Appeal to the Court of Special Appeals denied, Circuit Court Decision reinstated affirming Board of Appeals   

    denial of application for rezoning.  History: Applicant purchased a residential lot with three year old residence

    on Veterans Highway.  Residence burned down on a Sunday night, applicant moved an office trailer onto  

    foundation of former residence.  Operated a landscape business and alarm business with heavy equipments.  

    District Court found zoning violations. Consent Decree was entered that provided for removal of all violations. 

    By applying for C2 rezoning the Consent Decree went into hiatus and the violations continued to date.  Zoning

    Enforcement will follow and enforce the Consent Decree when time for further appeal expires.  This Court of

    Special Appeals Decision reinforces Circuit Court analysis in the Berrywood case above since in both cases

    Applicant used the same theory of mistake.  Opinion dated 7-16-09, Mandate filed 8-17-09, Motion for

    reconsideration deadline 8-17-09, Not filed. Certiorari to Court of Appeals deadline 9-1-09. Not filed.
